Application made to the Court of Appeal to review its judgement on affirming the conviction of a businessman over a VAT fraud

An applica4on has been filed in the Court of Appeal by businessman Kamil Kuthubdeen convicted of value-added tax (VAT) fraud, seeking to have a five-judge bench appointed to re-examine the evidence in his case before the Court of Appeal.

Kamil Kuthubdeen was found guilty by the High Court and had his conviction upheld by the Court of Appeal on December 13, 2023.

An appeal to the Supreme Court was filed against this Judgement.

Senior Deputy Solicitor General Shanil Kularatne with State counsel Manisha de Silva filed the objections on behalf of the AG.

The objections were raised on the grounds that the appeal has already been considered by the Court of Appeal and the appeal against that judgement is pending in the Supreme Court.

The plea has been made eight months after the appeal judgement was issued.

The plea had been filed by Faizer Musthapha on behalf of Kuthubdeen.
